| Invalid je oseba, ki pridobi status invalida po tem zakonu ali po drugih predpisih in oseba, pri kateri so z odločbo pristojnega organa ugotovljene trajne posledice telesne ali duševne okvare ali bolezni in ima zato bistveno manjše možnosti, da se zaposli ali ohrani zaposlitev ali v zaposlitvi napreduje. A disabled person is a person who gains a disability status according to the Vocational Rehabilitation and Employment of Disabled Persons Act or other regulations; it is a person with a decision of the competent authority declaring he or she is incapable of pursuing regularly any substantially gainful occupation because of a physical or mental impairment. The definition of a disabled person is based on the International Classification of Functioning, Disability and Health (ICF). |

Disability status is regulated by law for those disabled persons who have not been granted a disability status according to other regulations. The status can be gained under conditions set in the Vocational Rehabilitation and Employment of Disabled Persons Act. |
| Zaposlitvena rehabilitacija je individualizirana pravica invalida, je sklop storitev, s katerimi se povečuje zaposljivost invalida in je ni moč izvajati brez aktivnega sodelovanja invalida. Cilj zaposlitvene rehabilitacije je, da se invalida usposobi za ustrezno delo, da se zaposli, da zaposlitev obdrži oz. da v njej napreduje, ali da spremeni svojo poklicno kariero. Do zaposlitvene rehabilitacije so upravičeni tisti invalidi, ki po drugih predpisih nimajo pravice do enakih storitev rehabilitacije in če izpolnjujejo v predlogu zakona opredeljena merila. Izvaja se kot javna služba, njeni izvajalci pa so javni zavodi oz. koncesionarji v okviru mreže izvajalcev zaposlitvene rehabilitacije. |
Vocational rehabilitation is an individual right of a disabled person, it is a collection of services which enhance employability of a disabled person, and cannot be carried out without an active participation of a disabled person. The aims of the vocational rehabilitation is to qualify a disabled person for a suitable occupation, to get the person employed, to keep the employment and progress in it, or to change his or her professional career. Disabled persons who are not entitled to the same rehabilitation services under other regulations, but meet the criteria set by the Vocational Rehabilitation and Employment of Disabled Persons Act, are entitled to vocational rehabilitation. Rehabilitation is carried out as a public service, its holders being public institutions or concessionaires working within the net of rehabilitators. |
| Strokovni delavci in sodelavci izvajajo naloge, povezane z zaposlitveno rehabilitacijo in zaposlovanjem invalidov. Predlog zakona jih deli na tri skupine. V prvi skupini so visoko strokovno usposobljeni delavci medicinske, pedagoške, psihološke in podobnih smeri in z znanji s področja invalidskega varstva, rehabilitacije in zaposlovanja, pridobljenega s specializacijo, dodatnim izobraževanjem ali usposabljanjem. V drugi skupini so strokovnjaki, ki nudijo tehnično podporo, v tretji pa osebe, ki invalidom v zaposlitvi nudijo podporne storitve, ki imajo certifikat o poklicni kvalifikaciji ali druga dokazila o usposobljenosti za opravljanje takih del (npr. tolmač ali osebni asistent). |
Specialised Staff Members carry out tasks related to vocational rehabilitation and employing disabled persons. They are divided into three groups. The first group consists of highly educated staff working in the fields of medicine, pedagogy, psychology, etc. possessing knowledge from the field of disabled person security, rehabilitation and employing, obtained by specialising, additional education and training. The second group consists of experts, who offer technical support; and the third group consists of persons, who offer disabled persons support services, who possess certificates of their vocational qualification or other proof of qualification for carrying out such tasks (e.g. interpreters or personal assistants). |
| Rehabilitacijski načrt določa vrsto, obseg, način in trajanje izvajanja storitev zaposlitvene rehabilitacije, ki so individualno določeni in jih je izvajalec zaposlitvene rehabilitacije dolžan v celoti upoštevati. Rehabilitacijski načrt v sodelovanju z invalidom na podlagi mnenja rehabilitacijske komisije izdela rehabilitacijski svetovalec. Med izvajanjem rehabilitacije se rehabilitacijski načrt glede na potrebe invalida lahko spremeni ali dopolni. |
Rehabilitation plan defines the manner, extent and duration of carrying out vocational rehabilitation services which are individually determined and have to be followed strictly by the person carrying out the rehabilitation. Rehabilitation plan is created by a rehabilitation councillor in cooperation with a disabled person on the basis of the opinion of a rehabilitation committee. During the process of carrying out the rehabilitation, the rehabilitation plan can be changed or supplemented according to the needs of a disabled person.

| Ocena zaposlitvenih možnosti se izdela na podlagi mesečnih poročil in končne evalvacije izvajalcev zaposlitvene rehabilitacije. Iz ocene zaposlitvenih možnosti mora biti razvidno predvsem, ali je invalid zaposljiv v običajnem delovnem okolju, v podporni ali zaščitni zaposlitvi, za katera dela je usposobljen in kakšne podporne storitve ali prilagoditve potrebuje na delovnem mestu. |
An estimate of employment possibilities is created on the basis of monthly reports and final evaluation by the vocational rehabilitators. The estimate of employment possibilities has to clearly state whether a disabled person is employable in a regular working environment, in a supported or sheltered employment, which tasks the person is qualified to do, and what support services or accommodations are needed for the workplace. |
| Odločba o zaposljivosti je izdana, če je na podlagi ocene zaposlitvenih možnosti ugotovljeno, da invalid ni zaposljiv ali da je zaposljiv v zaščitni oziroma podporni zaposlitvi. Invalid lahko na podlagi odločbe o zaposljivosti uveljavlja subvencijo plače, delodajalec pa druge vzpodbude, ki so namenjene za zaposlovanje invalidov. Decision of employability is issued if it is established on the basis of an estimate of employment possibilities that a disabled person is not employable or that he or she is employable in a sheltered or supported employment. On the basis of the decision of employability, a disabled person can qualify for subsidising of salary, and the employer for other forms of encouragement intended for promoting disabled person employment. Disabled persons with the decisions of not being employable can enrol into programmes of social involvement. |

Zaščiteno delovno mesto se lahko invalidu zagotavlja v zaposlitvenem centru ali pri drugih delodajalcih, če izpolnjujejo zakonsko določene pogoje. Prav tako se za zaščitno zaposlitev lahko šteje tudi opravljanje dela invalida na domu. Delodajalec običajno delovno mesto delavca-neinvalida razdeli na več funkcionalno povezanih delovnih mest, ki predstavljajo zaščitena delovna mesta za invalide. Invalid, ki ima sklenjeno pogodbo o zaposlitvi na zaščitenem delovnem mestu, ima skladno s predlogom zakona tudi pravico do subvencije plače, skupni prejemki iz naslova delovnega razmerja pa ne smejo presegati z zakonom določene minimalne plače. |
Sheltered employment is an employment of a disabled person in a working environment adapted to the abilities and needs of a particular disabled person who cannot be employed in a regular working place. A sheltered working place can be available in employment centres or with other employers if they meet the conditions set by the laws. Another form of work that can be considered a sheltered employment is working at home. The employer divides a regular working place intended for a non-disabled person into several functionally connected work places, which represent sheltered working places for disabled persons. According to the law a disabled person who signed a sheltered employment contract has the right to a subsidised salary. The total income from the employment relationship, however, must not exceed a minimum wage set by the law. |
| Zaposlitveni center je pravna oseba, ki zaposluje invalide izključno na zaščitenih delovnih mestih, torej le invalide, za katere bo z odločbo Zavoda ugotovljeno, da so zaposljivi le v zaščitni zaposlitvi. Občine skrbijo za vzpodbujanje ustanavljanja zaposlitvenih centrov na svojem območju. S splošnim aktom bo zaposlitveni center opredelil število zaščitenih delovnih mest za invalide in število delovnih mest za strokovne delavce in sodelavce, katerih plače se bodo financirale iz javnih sredstev. Minister, pristojen za invalidsko varstvo, pa bo predpisal kadrovske, organizacijske, tehnične in druge pogoje za ustanovitev zaposlitvenega centra. Zagotavljanje sredstev za ustanovitev oziroma za začetek dela zaposlitvenega centra bo urejeno v aktu o ustanovitvi centra. |
Employment centre is a legal entity employing exclusively disabled persons at sheltered working places, namely, only disabled persons with decisions that they are only employable in sheltered employment. Municipalities are in charge of encouraging establishing employment centres in their respective areas. With a general legal act, an employment centre will define the number of sheltered working places for disabled persons and the number of working places for specialised staff members financed from public resources. The minister in charge of disability security prescribes the personnel, organisational, technical and other conditions for establishing employment centres. Providing funds for establishing or commencing work in an employment centre will be established in the instrument of constitution of the centre. |
| Podporna zaposlitev je zaposlitev invalida na delovnem mestu v običajnem delovnem okolju s strokovno in tehnično podporo invalidu, delodajalcu in delovnemu okolju. Strokovna podpora delodajalcu in delovnemu okolju se zagotavlja prvenstveno s seznanjanjem z invalidnostjo, njenimi posledicami in vplivi delovnega okolja na invalidnost ter svetovanjem o optimalnih možnostih prilagoditve delovnega okolja. Invalidu se v podporni zaposlitvi glede na njegovo invalidnost lahko zagotavljajo podporne storitve. Glede na oceno doseganja delovnih rezultatov je invalid v podporni zaposlitvi lahko upravičen do subvencije plače, v višini od 5 do 30% izhodiščne plače tarifnega razreda delovnega mesta zaposlenega invalida po veljavni kolektivni pogodbi oziroma minimalne plače, če je le-ta višja. |
Supported employment means employing a disabled person at a regular working place in a regular working environment with an expert and technical support to the disabled person, employer and working environment. Expert support to the employer and the working environment consists mainly of informing the employer with disabilities, its consequences and influences of working environment on disability, and counselling about optimal possibilities of accommodating the working environment. Support services can be available to a disabled person in supported employment according to his or her disability. According to the estimate of achieved working results, a disabled person in supported employment may be entitled to salary subsidies ranging from 5 to 30% of the starting salary of the working place he or she is occupying according to the valid collective labour agreement or of the minimal salary if the latter one is higher. |
| Podporne storitve so strokovna in tehnična podpora invalidu in delodajalcu pri uvajanju v delo in na delovnem mestu s svetovanjem in usposabljanjem, osebno asistenco, spremljanjem pri delu, razvojem osebnih metod dela in ocenjevanjem njegove delovne uspešnosti ter tehnična podpora s prilagoditvijo delovnega mesta in sredstev za delo. Podporne storitve izvajajo strokovni delavci in sodelavci, ki so zaposleni pri izvajalcu zaposlitvene rehabilitacije, v zaposlitvenih centrih ali invalidskih podjetjih, lahko pa tudi druge fizične osebe, ki izpolnjujejo pogoje za opravljanje teh storitev v skladu s predpisi. |
Supported services are expert and technical support to a disabled person and an employer during the introduction into work, and during work by counselling and training, personal assistance, supervising, developing personal methods of working and evaluating his or her working achievement, technical support with the accommodating of the working environment, and working instruments. Supported services are carried out by the specialised staff members employed by the institution carrying out the vocational rehabilitation, in employment centres or disability enterprises, or other individuals meeting the demands for conducting these services according to the regulations. |
| Invalidska podjetja so oblika socialne ekonomije na področju zaposlovanja invalidov. S predlogom zakona so podrobneje določeni pogoji za poslovanje, postopek pridobitve statusa in način poslovanja. Glede na dejstvo, da so invalidska podjetja gospodarske družbe posebnega pomena, predlog zakona delno predpisuje način delitve dobička, določa vpliv države na lastništvo in odločanje ter predvideva obvezno revizijo letnih in poslovnih poročil za vsa invalidska podjetja po posebnih pravilih revidiranja invalidskih podjetij. |
Disabled enterprises are a form of social economy in the field of employing disabled persons. The Vocational Rehabilitation and Employment of Disabled Persons Act more precisely sets the business conditions, the procedures for obtaining the status and the manner of conducting business. Considering the fact that disabled enterprises are companies of particular relevance, the before mentioned act partly prescribes the manner of profit division, sets the influences of the state on the ownership and decisions, and it assumes the annual obligatory auditing of reports for all disabled enterprises according to the rules for auditing disabled enterprises. |
| Kvotni sistem zaposlovanja invalidov pomeni obvezno zaposlovanje določenega števila invalidov ali sklepanja poslovnih pogodb v predpisani višini ali pa plačevanje prispevkov za namene pospeševanja zaposlovanja invalidov. Najvišja predvidena kvota bo 6% od skupnega števila zaposlenih delavcev in najnižja 2%. V kvoto se vštevajo vsi invalidi, ki jim je bil z odločbo priznan status invalida in invalidi, ki imajo trajne posledice telesne ali duševne okvare ali bolezni in imajo zato bistveno manjše možnosti, da se zaposlijo ali ohranijo zaposlitev ali v zaposlitvi napredujejo ter imajo sklenjeno pogodbo o zaposlitvi za najmanj 20 ur tedensko. Quota system of employing disabled persons means a compulsory employing of a certain number of disabled people, concluding contracts for set amounts of money, or paying contributions to the fund for promoting employing of disabled persons. In Slovenia the prescribed quota ranges from 2 to 6% of all employees - depending on the type of the organisation. The quota comprises all disabled persons with decisions giving them status of disabled persons, and those who have lasting consequences of physical or mental defects or illnesses and they thus have diminished capacities for finding employment or progressing in one, and they have an employment contract for at least 20 hours per week. Disabled persons employed in a sheltered employment at a regular working place count as 1.5 employed disabled person and disabled persons employed in a supported employment count as 2 employed disabled persons. |

Encouragements for employing disabled persons are salary subsidies, payment of costs of accommodating work places and instruments, paying the service costs for the supported employment, exemption from paying the contributions for pension and disability insurance for the disabled employees, rewards for exceeding quota, annual awards to employers for good practices in the field of employing disabled persons and other encouragements in the field of employing disabled persons and preserving working places for disabled persons and other developmental encouragements. |
| Subvencija plače invalidom je pravica invalidov zaposlenih na zaščitenih delovnih mestih, do nje pa so lahko upravičeni tudi invalidi, zaposleni v podporni zaposlitvi in v invalidskih podjetjih. Višina subvencije plače se odmerja za invalide, zaposlene v podporni zaposlitvi in v invalidskih podjetjih od izhodiščne plače tarifnega razreda delovnega mesta invalida po veljavni kolektivni pogodbi ali minimalne plače, če je ta višja, za invalide, zaposlene na zaščitenih delovnih mestih, pa je osnova za izračun subvencije minimalna plača. Višina subvencije plače invalida je določena v razponu v odstotkih, za posameznega invalida pa se odstotek določa individualno glede na doseganje njegovih delovnih rezultatov. Subvencija plače invalida je sestavni del plačila za njegovo delo po pogodbi o zaposlitvi. |
Subsidised salary - all disabled persons employed in sheltered employment, in supported employment and in employment centres have the right to subsidised salaries. The salary subsidy amounts for those employed in supported employment and those working in disabled enterprises is calculated according to the starting salary or the minimal salary if the latter is higher, for those disabled persons who work in sheltered employment the basis for the subsidy is the minimal salary. The range of salary subsidy amounts is set in percentages individually calculated for each individual disabled person on basis of his or her achieved working results. The subsidy is a part of one's payment for his or her work according to the employment contract. |
| Kvota - delodajalci imajo po zakonodaji obvezo, da zaposlujejo določeno število invalidov med vsemi zaposlenimi: 7% v Italiji, 6% v Franciji, 5% v Nemčiji, 4% v Avstriji, 2% v Španiji. V kvoto se upoštevajo le invalidi, ki imajo status (registrirani). Kvote se v vseh navedenih državah nanašajo na zasebni in javni sektor. Velikost podjetja je odločilna za obvezo izpolnjevanja kvote. Večinoma so manjša podjetja oproščena izpolnjevanja kvote, minimalno število vseh zaposlenih v podjetju, ki ga kvota zavezuje, je običajno med 15-25 delavci. Nekatere države upoštevajo kot dvojno ali trojno enega težjega invalida. Izpolnjevanje kvote je večinoma med 50-70%. |
Quota - according to the legislation, the employers are obligated to employ a certain number of disabled persons: 7% in Italy, 6% in France, 5% in Germany, 4% in Austra, 2% in Spain. Only registered disabled persons with a disability status are considered in the quota. The quotas in all the countries apply both to privat and public sectors. The size of a company is the crucial factor for establishing quota. Most smaller companies are exempt from fulfilling the quota; the minimal number of all employees in a company binden by quota is between 15 and 25 employees. Some states consider those disabled persons with higher levels of disability as two or three disabled persons. The fulfilment of quota tends to be between 50 and 70%. |
| Invalidnost ne pomeni »nesposoben za delo« (unable to work, inable). Medtem ko državne politike in družba kot celota spodbuja integracijo invalidov, to manj velja za delodajalce in same invalide. Vsak invalid naj bi bil udeležen v primernem programu, glede na individualne sposobnosti in potrebe. Ni dovolj samo dohodkovna oz. denarna podpora. Tak individualni program lahko vsebuje rehabilitacijo, poklicno usposabljanje, podprto iskanje dela, oblike dela (na odprtem trgu dela, part-time, subvencionirano, zaščitno), poleg denarnih prejemkov. Lahko pa vključuje tudi aktivnosti, zasnovane na socialni integraciji invalidov. |
Disability doesn't mean "unable to work". While state politics and the society as a whole encourage integration of disabled persons, the employers and the disabled persons themselves often don't. Every disabled person should be involved in a suitable programme, according to the individual capacities and needs. Finantial support is not enough. Such individual programme can include rehabilitation, vocational training, supported work search, forms of work (in the open market, part time, subsidised, sheltered), beside the finantial incomes. It can also include activities based on social integration of disabled persons. |
